These Terms & Conditions govern the use of PhilProVA’s recruitment and placement services. By engaging PhilProVA, you agree to the terms outlined below.

Clients agree to:

  • Provide accurate role requirements, expectations, and compensation details

  • Participate in interviews and provide timely feedback

  • Comply with applicable employment, labor, and tax laws related to hiring

PhilProVA is not responsible for a client’s internal hiring decisions or employment practices.

1. Client Responsibilities
2. When Payment Is Due

Clients are charged only after a successful hire.

A “successful hire” is defined as:

  • The client confirming acceptance of an offer, and

  • The candidate agreeing to start employment.

PhilProVA charges a one-time placement fee for recruitment and placement services.

Payment is due only after a successful hire, defined as:

  • The client confirming acceptance of an offer, and

  • The candidate agreeing to start employment.

Salary, benefits, and ongoing employment costs are paid directly by the client to the hired candidate.

3. Fees & Payment

Refunds are governed by PhilProVA’s Refund Policy, which forms part of these Terms & Conditions.

Because PhilProVA provides time-based recruitment services, refunds are limited once services have been delivered or a hire has been made.

5. Refunds

If a hired candidate leaves within 30 days of their start date due to performance or role fit, PhilProVA will provide a one-time replacement search at no additional cost, subject to the original role scope and requirements.

4. Replacement Guarantee
6. No Guarantee of Employment Outcomes

While PhilProVA aims to present qualified candidates, we do not guarantee:

  • A specific hiring outcome

  • Candidate performance after hire

  • Employment duration or retention beyond the replacement guarantee

Final hiring decisions rest solely with the client.

7. Limitation of Liability

To the maximum extent permitted by law, PhilProVA shall not be liable for:

  • Indirect, incidental, or consequential damages

  • Business losses, lost revenue, or operational disruptions

  • Actions or conduct of hired candidates after employment begins

PhilProVA’s total liability shall not exceed the placement fee paid by the client.

Clients agree to contact PhilProVA directly to attempt resolution of any disputes before initiating chargebacks or legal claims.

Unresolved disputes may result in suspension of services.

8. Disputes

PhilProVA may update these Terms & Conditions from time to time.
Continued use of services constitutes acceptance of the updated terms.
